Welcome to Mydrobe! This Terms of Service Agreement (“Agreement”) is a legal contract between you (“you” or “your”) and Mydrobe, Inc. (“we”, “us”, “our”, or “Mydrobe”) that governs your use of our website located at Mydrobe.com.au.

Please review these terms carefully. By accessing or using any of our services, you acknowledge that you have read, understood, and agree to comply with these Terms. By accepting them, you confirm that you are of legal age (18 years or older) to enter into a binding contract, as this Agreement represents a legally binding contract between you and us.

We, at Mydrobe, reserve the right to modify these Terms at our discretion, at any time.

Additionally, we reserve the right, at our sole discretion, to limit, suspend, or terminate access to our Services for any reason, including but not limited to concerns over availability, geographic restrictions, or suspected violations of these Terms, such as fraudulent activity or commercial use.

By accessing and using the Site or Service, or by purchasing any of our memberships, you confirm that you have read, understood, and agree to comply with these Terms and Conditions. Your acceptance of these Terms creates a binding agreement between you and Mydrobe, including any future updates or changes made by Mydrobe.

Hire period:

Mydrobe hire periods are a 48 hour period. The product/s must be returned on or prior to the 48 hours from hire, via drop off at our store. Failure to to return the product after our 72 hours rental period is a violation of our Terms and will result in us charging your Payment Method for Late Fees. Failure to return the product within 7 days you will be charged for a new product,cancel your account and/or take take legal action.

If you can’t return the product due to medical reasons or emergency get in touch with us directly via email.

Pickup & drop off:

Pickup is available from our ** store address *** , opening hours 3:30-6:30pm. Your product will be ready for pick-up on your selected booking date. Please ensure you arrange collection during our business operating hours. You acknowledge that the return date will not be extended if you are to pick up the product late.

Returns must be dropped off at our *** store during business hours at the front desk. You agree to return each product by the agreed return date, which is 48 hours after your selected hire date, unless other arrangements have been made with Mydrobe.

Responsibility:

You agree to provide and continually update your most up to date and complete information, including your full name, current email address, mobile number, postal address, and bank card details, when creating an account with Mydrobe. If there is any changes to the information above you are to update your account. while ensuring you maintain a single account per Paid Service, keep your credentials secure, and use the Services and Products solely for personal purposes without any commercial or third-party benefit. You are solely accountable for any use of services and/or products that breaches these Terms or any relevant laws and additional terms. Mydrobe is not responsible for any theft, loss, or damage to the product, nor for any fees or expenses incurred if the product is not returned on time.

Late fees:

You acknowledge that if you fail to return one or more products by the scheduled return date, you authorize Mydrobe to charge your payment method for any accumulated late fees, up to the maximum limit, as well as any additional fees resulting from the delayed return that affect future bookings. These fees are non-refundable.

Late fees will be charged at $25 per day until the product is returned.

Cancellations fees

Cancellations made within 72 hours of your scheduled pickup date will be charged with a cancellation fee of $25, you authorise mydrobe to charge your selected payment method. Cancellations made before the 72 hours of your scheduled pickup date will not be charged with a cancellation fee.

Damages/lost of item:

If an item is damaged, misplaced, or stolen, you are responsible for contacting Mydrobe immediately at info@mydrobe.com.au. You will be liable for the costs of repairing the item, or the full retail price (RRP) of the dress if it is irreparable or lost due to theft or misplacement.

By signing up to become a member you accept the terms & conditions and herby authorise Mydrobe to charge your Payment Method for these fees should they be incurred.

Delays/ website malfunction:

Mydrobe is not responsible for any delays, omissions, or inaccuracies in its services, including the content. The services may occasionally be unavailable due to maintenance, equipment malfunctions, or other reasons. By using the services, you agree that mydrobe will not be held liable for any such delays, omissions, inaccuracies, or unavailability

In the event of website malfunctions, including but not limited to technical issues, interruptions, or disruptions, we are not responsible for any inconvenience or loss experienced by users. While we make every effort to maintain the website’s functionality, we cannot guarantee uninterrupted access or that the site will be error-free at all times.

Information we collect

Within this privacy policy, ‘Personal Information’ refers to data that directly identifies an individual, like a person’s name, or information that reasonably enables the identification of an individual indirectly, such as an email address, home address, or mobile phone number. Additionally, it encompasses information directly linked or combined with such identifying details.

– Passive Data Collection. This pertains to information automatically gathered from customers while they use our services.
– User-Submitted Information: This includes details actively provided by the customers, which may be voluntary or necessary for the utilization of our services.

The content provided through our services, including materials such as graphics, data, articles, text, images, photos, illustrations, and information, along with specific trademarks, service marks, names, and logos (e.g.,Mydrobe), collectively constitutes “our materials” and “content.” You acknowledge and agree that this content is: i) protected by copyright, ii) subject to various intellectual property and proprietary rights and laws, and iii) owned by us, our suppliers, and licensors. Without our prior written consent,mydrobe content may not be copied, republished, reproduced, posted, modified, sold, offered for sale, transmitted, redistributed, or used in any way.
You confirm, guarantee, and agree not to post, share, store, upload, provide, or make accessible any user submissions that violate these terms. You also agree to use the services in a manner that:
⁃ Does not infringe on the intellectual property rights of any party, including Mydrobe.
⁃ Complies with all applicable laws, rules, and regulations, including privacy and export control laws.
⁃ Refrains from engaging in harmful, deceptive, threatening, defamatory, obscene, or unlawful activities, or targeting specific groups based on race, religion, gender, or sexual orientation.
⁃ Does not misuse the services for commercial or other unintended purposes as defined by mydrobe.
⁃ Ensures the security of your account and the accounts of others, and does not permit unauthorized access (e.g., sharing your account with others).

Consent to receive messages from us:

By using our services, you consent to receive communications from us. These may include informational text messages and/or emails—such as order updates, reminders, verification requests, and other transaction-related notifications—sent to the phone number and/or email address you provided. These messages may be delivered via an automated system. You confirm and warrant that the contact details you provide during account creation are accurate and belong to you.

Indemnity:

You agree to indemnify and protect mydrobe and its affiliates from any claims, liabilities, damages, losses, costs, and expenses arising out of or related to: your use of our services or rented products; any content you submit; your violation of these terms or any applicable laws; infringement of any third-party rights; or disputes involving third parties.

⁃   Your access to or use of our services (including actions taken by others using your account) and any products rented from us, including failure to return those products;
⁃   Any content or submissions you provide;
⁃   Your violation of these Terms or any applicable laws, rules, or regulations;
⁃   Your infringement, misappropriation, or other violation of third-party rights, including intellectual property, privacy, publicity, confidentiality, or property rights;

-Any dispute or issue between you and a third party, including any service provider, merchant, product, or other external party.
If such a claim arises, we will attempt to notify you using the contact details linked to your account. However, our inability to deliver this notice does not affect your obligation to indemnify us.

Membership Policy:

We’re pleased to offer flexible membership options that can be cancelled or repurchased at any time. Our memberships are designed to provide ongoing value and benefits throughout the subscription period.
However, our membership model is intended to support continuous engagement—not short-term access driven by promotional opportunities. To ensure a fair and beneficial experience for all, we encourage members to maintain active subscriptions and fully enjoy the benefits we provide.
To preserve the integrity of our program, we reserve the right to introduce a minimum subscription period if we notice repeated patterns of cancellation and reactivation that conflict with the intended use of our service.
We also reserve the right to suspend or deny membership if we believe such action is necessary to uphold the quality and fairness of our community.

Payment:

You are responsible for keeping valid and up-to-date billing and contact information on your account You authorise mydrobe to charge your payment card or other Payment Method for the membership fee when you sign up. This fee will be charged immediately upon your membership order. In addition, you authorise mydrobe to charge your Payment Method for any Late Fees, Additional Fees and/or damage Fees that you are responsible for. 

Membership Cancellation:

You may cancel your Membership Service at any time by contacting us. However, all products in your possession must be returned to mydrobe before your cancellation can be processed.
If your payment method is cancelled (e.g., due to loss or theft), or if there is a suspected security breach involving your user ID or password, you must promptly notify us and update your payment information in your account settings.
If you fail to provide or update your payment details, you consent to us continuing to charge any valid payment method on file for any paid services linked to your billing account. This will remain in effect unless you cancel the services or terminate your account in accordance with these Terms

Available:

Availability of our rental items on specific dates is not guaranteed. Rentals are fulfilled on a first-come, first-served basis, and item availability depends on prior bookings by other customers.

Promotions:

Upon completion of your promotional period, you’ll automatically be enrolled to use the relevant paid service and charged accordingly, as per these terms, unless you cancel the paid service in accordance with these terms. Cancellation must be made prior to the end of the trial/promotion period should you not want to continue to use the service.  

Please note that the payment terms associated with signing up for a free trial or any other promotion are included in these terms.

Request a dress:

Members have Exclusive access to our ‘request a dress’ this is a Members only page where Our members can submit a request on a dress they would like us to add to MyDrobe collection. Mydrobe does not guarantee to accept all requests.

Partner discounts:

As part of our partnership program, we offer exclusive discounts to our clients through select partner stores. These discounts are provided at the discretion of the partner stores and may be redeemed either by showing your an active member with Mydrobe at the time of purchase or by using a designated discount code for online orders.
Please note that while we facilitate access to these offers, we are not responsible for the services, products, or experiences provided by our partner stores. If a discount is not applied or if you are dissatisfied with the service received, we recommend addressing the issue directly with the store in question. Additionally, we ask that you inform us by phone or email so we can follow up and ensure that all partnership terms are being upheld.
Discount availability and partner participation are subject to change at any time without prior notice. Discounts are available exclusively to active members, and we reserve the right to verify membership status with partner stores to confirm eligibility. Partner stores may also perform their own checks and notify us when services are used under our program, to validate membership.
Please be aware that discounts are non-transferable and may not be sold or shared with non-members. We are not liable for service-related issues, pricing discrepancies, or inventory concerns at partner locations.
Any attempt by a former member to fraudulently access member discounts such as misrepresenting their membership status will be considered a breach of our program terms. We reserve the right to take legal action in such cases to protect the integrity of our partnership program.
